Lawsuit Over Atkins Diet Clears First Legal
Hurdle
 |
Plaintiff Jody Gorran |
A landmark lawsuit spotlighting the dangers of the Atkins
diet cleared its first legal hurdle on November 2. Judge Susan
Lubitz of Palm Beach County Court ruled in favor of
Jody Gorran, a 53-year-old Florida resident who is suing Atkins
Nutritionals for the life-threatening artery blockage he suffered
after more than two years on the diet.
PCRM is providing legal representation for Gorran. His case was
filed in late May; the first hearing was held on October 26. Judge
Lubitz has denied Atkins Nutritionals’ motion to dismiss the
case.
A former volunteer fireman and advocate for children’s rights,
Gorran is motivated by his desire to protect others from a diet
he feels nearly killed him. By requesting only a small amount in
damages—less than $15,000—Gorran is making it clear
that he has not filed this suit to make money. He is also seeking
an injunction preventing the sale of Atkins books and products without
fair and adequate warnings about the dangers of the diet.

Do you know someone who’s been
harmed by a low-carb diet?
PCRM maintains a Web-based registry at www.AtkinsDietAlert.org
for those people who believe they’ve sustained health
problems from low-carb, high-protein diets. If you know someone
who fits this description, please encourage him or her to
register with us as soon as possible.
PCRM is working with the Centers for Disease Control and
Prevention to analyze the registry data and is also preparing
case histories for publication. Read
a report on the data gathered as of May 2004. |
