Dan Kinburn

Dan Kinburn is general counsel for the Physicians Committee for Responsible Medicine (PCRM), a nationwide organization of physicians and laypersons that promotes preventive medicine, especially good nutrition, and addresses controversies in modern medicine, including ethical issues in research. 

As general counsel, Mr. Kinburn is PCRM’s lead trial counsel. He directs PCRM’s advocacy litigation, which challenges industry and government when they promote the consumption of animal products and other unhealthy foods, and uses litigation to promote vegetarian diets as well as alternatives to the use of animals in medical research and education.

Two of Mr. Kinburn’s most important cases for PCRM are class action lawsuits against the dairy industry: one to end a multimillion dollar advertising campaign falsely claiming that dairy consumption aids in weight loss, and the other to require that milk producers put warning labels about lactose intolerance on all milk cartons. Mr. Kinburn is also leading groundbreaking lawsuits against the Atkins Diet empire for its false and misleading claims that a high-fat, high-meat diet is safe and against the drug company Merck for its negligent reliance on animal-testing results to market and sell the dangerous drug Vioxx. Mr. Kinburn has also been involved in several lawsuits against the United States Environmental Protection Agency, which directs the killing of tens of thousands of animals each year in cruel experiments.

Mr. Kinburn earned his Bachelor of Arts in political science from the State University of New York at Albany. He received his law degree from Columbia University School of Law in New York in 1979. 

Mr. Kinburn started his legal career as an assistant attorney general for the state of New York, engaging in complex constitutional and class action litigation at the trial and appellate levels. Thereafter, he served as an associate and then partner in private law firms where he specialized in complex civil litigation in state and federal courts. Mr. Kinburn later formed his own firm, Dwyer Kinburn Hall & Golub, before leaving private practice to join PCRM.

Mr. Kinburn is a member of the New York and New Jersey Bars and has been admitted to the federal courts of New York (Eastern, Southern, and Northern districts) and New Jersey, the District Court for the District of Columbia, and the Second and Third Circuit Courts of Appeal.
